Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of JunkMetrix, including our websites, applications, and related services (the “Service”). By creating an account, accepting an invite, checking an agreement box, or otherwise using the Service, you agree to these Terms. If you are accepting on behalf of a business, you represent that you have authority to bind that business.

2. Compliance with laws

You agree to use JunkMetrix only in compliance with all applicable local, state, provincial, national, and federal laws and regulations, including laws related to data privacy, consumer protection, employment, waste hauling and disposal, environmental rules, advertising, and electronic communications. You are solely responsible for how your business uses the Service and for the legality of your operations.

3. Your account and workspace

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account and business workspace. Notify us promptly if you suspect unauthorized access. Workspace admins control who is invited and what roles they receive.

4. Your content

You and your business retain ownership of the customer, job, billing, and other business data you enter into JunkMetrix (“Customer Data”). You grant us a limited license to host, process, back up, and display Customer Data solely to provide and improve the Service as described in our Privacy Policy.

5. Acceptable use

You agree not to:

  • use the Service for unlawful, fraudulent, harassing, or harmful purposes;
  • upload malware, attempt to probe or disrupt systems, or bypass access controls;
  • scrape, reverse engineer, or resell the Service except as we expressly allow;
  • misrepresent your identity or affiliation; or
  • interfere with other customers’ use of JunkMetrix.

6. Service availability

We aim to keep JunkMetrix reliable, but the Service is provided “as is” and “as available.” We may modify, suspend, or discontinue features with reasonable notice when practical. We are not liable for downtime, data transmission delays, or third-party outages (including email, maps, SMS, or calendar providers).

7. Messaging allowances and overage fees

Unless we agree otherwise in writing for your workspace, your subscription includes a monthly messaging allowance of up to 500 SMS messages and up to 1,000 emails sent through the Service (or features we enable that send on your behalf). Allowances reset each billing month for your business workspace.

If your workspace exceeds those amounts in a given month, you may incur additional fees for the overage. We may notify workspace admins before or after an overage, throttle or temporarily pause further sends until the overage is addressed, and/or invoice overage charges to the account on file. You remain responsible for complying with all laws that apply to your messages (including consent, opt-out, and anti-spam rules).

8. Disclaimer of warranties

To the fullest extent permitted by law, JunkMetrix and its operators disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet every operational need.

9. Limitation of liability

To the fullest extent permitted by law, JunkMetrix and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising from or related to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim, or (b) one hundred U.S. dollars (US $100) if you paid nothing.

10. Indemnification

You agree to defend, indemnify, and hold harmless JunkMetrix and its operators from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

11. Suspension and termination

We may suspend or terminate access if you violate these Terms, if required by law, or if continued use creates risk to the Service or others. You may stop using the Service at any time. Provisions that by their nature should survive (including ownership, disclaimers, liability limits, and indemnity) will survive termination.

12. Changes

We may update these Terms from time to time. When we make material changes, we will update the effective date and version and may require you to accept the new Terms before continuing. Continued use after acceptance constitutes agreement to the updated Terms.
